Qualified Tips:
The IRS has issued final regulations explaining a new tax deduction for “qualified tips.” This rule applies to tax years 2025 through 2028 and is designed to benefit workers who receive tips as part of their work.
What is the deduction?
Individuals can deduct the amount of qualified tips they receive during the year—provided those tips are properly reported (for example, on a W-2 Form, 1099-NEC, 1099-K or Form 4137).
Deduction Limits:
- The deduction is capped at $25,000 per year, regardless of filing status.
- It begins to phase out if income exceeds:
- $150,000 (single)
- $300,000 (married filing jointly)
The deduction is reduced by $100 for every $1,000 over these thresholds.
What counts as “qualified tips”?

- Cash tips earned in jobs regularly received before 2025.
- Voluntary payments from customers (not mandatory service charges)
- Tips received in cash, check, credit card, debit card, gift card, or other cash-equivalent forms.
- Non-cash items (e.g. event tickets, meals, services or digital assets) do not qualify.
Who is eligible?
Only workers in specific tipped occupations listed by the TTOC qualify. It includes a wide range of services, hospitality, entertainment, personal care, and delivery occupations (e.g., wait staff, bartenders, taxi drivers, hairdressers, hotel staff, etc.)
Self-employed individuals: your deduction cannot exceed your net business income from that trade or business.
Important exclusions:
Tips are not qualified if:
- Received as a specified service trade or business (SSTB) as defined in section 199A(d)(2). (like consulting or legal services).
- The income is tied to illegal activities.
- You have an ownership relationship with the person paying the tip.
- Payments are being reclassified as “tips” just to claim the deduction.
Reporting requirements:
- Tips must be properly reported (W-2, 1099, or Form 4137).
- You must include your Social Security Number.
- Married couples must file jointly; only the SSN of the spouse who received the tips is required unless both are claiming the deduction.
